Fluentella’s Privacy Policy
PART 1: WHY DO WE NEED YOUR INFORMATION?
As part of the buying and selling process, we collect some personal information you provide us such as your name and email address to use for administrative purposes when you enroll at Fluentella. We use the information you provide about yourself when placing an order for classes only to complete that order. We do not share this information with outside parties except to the extent necessary to complete that order.
When you make use of our website, we automatically receive your computer’s internet protocol (IP) address from Google in order to provide us with information that helps us learn about your browser and operating system. Google Analytics is a web analysis service provided by Google Inc. (“Google”). Google uses the Data collected to track and examine the use of this website, to prepare reports on its activities and share them with other Google services. Exactly like any other website on the internet.
This means that Fluentella will be able to monitor and analyze web traffic and this will be used to keep track of User behavior.
Email marketing: With your permission, we will occasionally send you emails about our services and other updates. We use return email addresses to answer the email we receive. Such addresses are not used for any other purpose and are not shared with outside parties whatsoever. We advise you to save hello@fluentella.com to your address list so that you never miss any important updates via email.
We comply with the Protection of Personal Information Act No. 4 of 2013 (POPIA) and the principles outlined in Sections 50 and 51 of the Electronic Communications and Transactions Act No.25 of 2002 (ECTA) which govern your right to having your personal information kept private.
We do not sell, trade, or rent Users personal information to others. The only individuals who see your information are those who work for Fluentella, such as teachers and managers. They are all trusted by Fluentella. The only reason such people would see your information is to provide a service to you as per your request.
PART 2: YOUR PERMISSION
How do we get your consent? When you place an order and make an appointment with one of our teachers, we imply that you consent to our collecting your information and using it for that specific reason only.
If we ask for your personal information for an additional reason, like marketing, you will be asked directly for your expressed consent in writing, or provide you with an opportunity to decline.
By making use of our services, you give Fluentella consent to capture moments during our lessons using our webcams. These pictures will strictly be used for marketing or to train future teachers. If Fluentella would like to use images of your child for marketing reasons, you will be contacted and your written permission will be required before we commence. When asked for consent, you will receive the following message:

+ that the images of my child are the copyright of Fluentella
+ that you can ask Fluentella to stop using your child’s images at any time, in which case they will not be used in future publications but may continue to appear in publications already in circulation;
Please remember that your or your child’s full name or personal information will under no circumstances be available to the public.
How do I withdraw my consent? If you decide to change your mind, you may withdraw your consent for us to contact you, for the continued collection, use or disclosure of your information, at anytime, by contacting us at hello@fluentella.com or on our website. No questions asked.
PART 3: DISCLOSING YOUR INFORMATION
If we are required by law to do so or if you violate our Terms of Service, we may disclose your personal information to the relevant authorities.
PART 4: THIRD-PARTIES
In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us.
However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions.
Once you leave our store’s website or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our website’s Terms and Conditions.
When you click on links on our website, they may direct you away from it. We are not responsible for the privacy practices of other sites and encourage you to read their privacy statements carefully before continuing.
PART 5: YOUR SECURITY
To protect your personal information, we take all reasonable precautions to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed. You can access and correct errors on all your personally identifiable information that we collect online by sending us an email. We use this procedure to keep your information safe. Your personal and contact information is not accessible to other Fluentella students.
PART 6: AGE OF CONSENT
By using our site, you represent that you are not a minor. In the United States as of 1995, a minor is generally legally defined as a person under the age of 18. See our Terms and Conditions for more information on your responsibilities as a parent and a student.
Protection of Children’s Information: Children under 15 years old are not allowed to subscribe or create an account without the assistance of a person of age. Only a parent, guardian, or teacher can register the children on the site or give them access to any of Fluentella’s services. In the event that a person under the age of 15 enrolls at Fluentella, the person will be contacted and their permission to use the site denied.
Parents/teachers/students of age will be asked to read the Terms and Conditions and accept them by ticking a box during the registration process. After the registration process, students can not upload any personal or identifiable pictures.
PART 7: YOUR RIGHTS
You may exercise certain rights regarding your Data processed by Fluentella.
You may:
- Withdraw your consent at any time. Students or parents have the right to withdraw consent where they have previously given their consent to the processing of their Personal Data or images used for marketing purposes.
- Seek rectification. Students of age or parents have the right ask for their information to be updated or corrected.
- Have your Personal Data deleted or otherwise removed. You have the right to delete your Fluentella membership account yourself and to request that your information be deleted from the Fluentella databases.You have the right to lodge a complaint to the Information Regulator:

PART 8: CHANGES TO THIS PRIVACY POLICY
We reserve the right to modify this privacy policy at any time without notice. Changes and clarifications will take effect immediately upon their posting on the website.
PART 9: RETENTION OF PERSONAL INFORMATION
All personal information retained on our database, including such information obtained using our website, is in accordance with the retention provisions set out in the laws and regulations of South Africa, including those set out in POPIA.
We retain your personal information for as long as reasonably necessary to fulfill the purpose for which it was collected and to comply with laws, and your consent to such purpose remains valid after the termination of our relationship with you.
PART 9: MARKETING
With your consent, we may use your personal information to promote and market additional products, services, and special offers from us or our affiliates that may be of interest to you. When you visit our website, we may ask you if you want to sign-up to receive information and promotional offers.
If you decide to register for emails, you may opt-out of receiving such communications at any time. If you wish to opt-out, please contact us as per the details provided on the Contact Us page. If you do not provide us with your consent, some features on our website may not be available to you.
We will use your personal information for direct marketing purposes only if you give your consent to us or it is permitted by the laws.
In case you no longer want to receive this news or information, you may opt out of receiving such by responding to the newsletter and asking to be unsubscribed or calling us and asking to be taken off the list.
